Therapeutic Goods Association: New guidance for software-based medical devices

The Therapeutic Goods Association (TGA) has recently undertaken extensive consultation to clarify the boundaries of regulated software products. This included a proposal to exclude certain products from regulation by the TGA that are considered low risk, present a low risk to users or are subject to other mechanisms of oversight.

Following TGA consultation, the government has agreed to a number of changes to the regulation of medical devices. The TGA has implemented these changes through amendments to the Therapeutic Goods (Medical Devices) Regulations 2002, and the recently finalised Therapeutic Goods (Excluded Goods) Amendment (Software-based Products) Determination 2021 which will exclude certain types of software from regulation. The exclusions take effect from 25 February 2021.

Please note that an exemption has been introduced for some clinical decision support software which meet the definition of a medical device. Guidance relating to this will be published on the TGA’s website over the coming weeks.
