The RACGP has provided a submission to Ahpra about the changes to the Health Practitioner Regulation National Law. The changes include significant new powers for Ahpra and the National Boards, including the new power to issue public statements about serious risks posed by people, including registered practitioners, who are the subject of investigations or disciplinary proceedings. The targeted consultation requested feedback on the clarity of the proposed approach to how the power will be used in practice.
Ahpra intends to incorporate a new chapter on public statements in the published Regulatory Guide in March 2023.
Our submission provides feedback on the proposed threshold tests to make a public statement, the procedures to be followed to support a statement being made, revised or revoked and the need for a comprehensive and tailored awareness and education campaign to assist with avoiding misunderstandings among practitioners and consumers.
